Frequently Asked Questions

Railway Claim Services, Inc. (RCSI) is the only national claim service providing independent claims and litigation management on behalf of insurance companies that insure railroads and railroad service companies throughout North America.

RCSI’s corporate offices are in Fort Worth, Texas; however, RCSI has offices and/or professional railroad claims personnel throughout the United States. All first notices are reported through RCSI’s corporate offices.

Railway Claim Services, Inc. provides independent accident investigation, claims management and litigation management services, and risk management services for railroads and those railroad-related industries that provide services for railroads.

RCSI provides special project claims investigation and claims management services for Class 1 railroads. Class 1 railroads have highly trained claims professionals that effectively protect the interests of the railroad.

RCSI provides services to short lines, regional railroads, railroad commuter lines, their insurance companies, and those railroad-affiliated companies that provide services for railroads.

Over the last 35 years, RCSI has become the leading claims service provider for those railroad-related industries that provide services for railroads.

No. RCSI provides services by contract for a large railroad population, but in most instances, RCSI does not find that we have a conflict with providing services for railroads or railroad-affiliated companies. Where there is a conflict or where there is the possibility of a conflict, RCSI will advise the client, and the client can decide how to continue to handle the claim. There, if a conflict occurs, RCSI will provide recommendations based on years of experience, so an informed choice can be made for an effective claims management process.

RCSI provides on-scene investigation where this has not been done, where additional investigation is needed, or where an investigation has not been completed by our clients.

On matters involving Class 1 railroads and RCSI’s contract clients, RCSI works directly with other railroad claims professionals to assure claims handling that is in the best interest of RCSI’s clients.

RCSI selects defense counsel from a very select group of attorneys, most of whom are members of the National Associations of Railroad Trial Counsel, the railroad industry association of train attorneys specializing in the defense of railroad claims/cases.

RCSI provides risk management services for RCSI clients on a when-needed, as-needed basis. RCSI has an effective loss prevention analysis that has been demonstrated to be very informative and effective in reducing losses for RCSI clients.

RCSI knows and understands the nuances of railroad claims and litigation. This knowledge makes sure that all claims are handled in order to minimize losses.

RCSI provides litigation management that brings accountability to attorneys retained to defend the interest of the crew hauling services and the railroads. This includes an early evaluation of the claim/lawsuit and a budget for the cost of defense.

RCSI knows the experts in this specialized field of railroad claims/litigation and can assure that when an expert can potentially mitigate the damages, the “right” expert is brought to the defense of the claim.

RCSI speaks the language of railroaders. The class of “railroaders” transcends railroad claims personnel, railroad management, and all those affiliated with railroads. By speaking the same language, RCSI personnel are “insiders.” As insiders, RCSI saves money for our clients.

In one sentence, Railway Claim Services serves as the third-party administrator of claims for our railroad clients and reduces the value of claims through effective claims and litigation management.
